Maintenance of household gas-using equipment (intra-apartment gas equipment, hereinafter VKGO) from 01.01.2018. became ANNUAL

The legal basis for this measure is Government Decree No. 410, adopted on May 14, 2013.

According to the latest amendments, Decree of the Government of the Russian Federation of September 9, 2017 N 1091 "On Amendments to Certain Acts of the Government of the Russian Federation on the Issues of Ensuring Safety in the Use and Maintenance of Household and Household Gas Equipment" must be concluded between each homeowner and a specialized organization that will check the gas-using equipment.

Also, do not forget that since 2003. Property owners are responsible for the condition of gas stoves, water heaters, indoor / outdoor heating boilers and other gas-using equipment.

If the owners do not want to conclude an agreement with specialized organizations, they may be subject to penalties by the State Housing Inspectorate, and the gas supply may also be suspended.

In connection with the amendments that came into force in the Resolution No. 1091 dated 09.09.2017. the company "Region 750" informs that from 01.01.2018. maintenance of the VCHO will be carried out annually.

The increase in the frequency of maintenance entailed an inevitable increase in the cost of the service agreement (previously, the frequency of maintenance of the VKGO was 1 time per 3 years, with the exception of equipment that, according to the manufacturer's instructions, had exhausted its resource). So, from the new year, the cost of the annual maintenance of the gas stove will be 89 rubles 94 kopecks per month (1079.28 rubles per year), and the service, which includes the annual maintenance of the gas stove and the water heater, will be carried out based on the cost of 209 rubles 88 kopecks per month (2518.56 rubles per year).

The contract for the maintenance of VKGO with the "Region 750" company provides for an inspection once a year. During the bypass, the specialist checks the condition and operation of all indoor gas equipment:

  • gas pipelines of an apartment or residential building,
  • connected to the gas distribution network,
  • gas-using equipment,
  • gas metering devices,
  • shut-off valves.

A detailed description of work for each type of equipment is spelled out in the contract.

During maintenance, the specialist must:

  • present a certificate confirming his qualifications and the right to carry out gas hazardous work;
  • visually check the condition of gas pipelines of the gas consumption network, gas-using equipment, the state of painting and fastenings of gas pipelines of the gas consumption network, the presence and integrity of cases in the places of laying through the external and internal structures of buildings;
  • check the tightness of connections and disconnecting devices of gas pipelines and gas-using equipment;
  • operability and lubrication of disconnecting devices of gas pipelines of the gas consumption network;
  • check the presence of draft in the smoke and ventilation ducts, the condition of the connecting pipes with the smoke duct in gas-using equipment;
  • operability of safety automation of gas-using equipment;
  • disassemble and lubricate gas taps;
  • adjust the gas combustion process for all operating modes of the equipment.

The agreement also guarantees round-the-clock emergency dispatch support on the basis of the Agreement on emergency dispatch support concluded between Region 750 LLC and Krasnogorskmezhraigaz branch of GUP MO Mosoblgaz.

The operation of gas equipment is a special area of ​​responsibility, since every omission can cost the lives of residents of the apartment building. Therefore, the service of the VDGO should be approached especially seriously, it is worthwhile to carry out explanatory work with the residents of the MKD who are in your service in a timely manner. Gas equipment located in public areas includes:

  • gas pipeline and risers from the point of connection with the citywide distribution network of gas supply to the entrance to the apartment;
  • fittings for regulating the supply of blue fuel;
  • ODU of gas volume;
  • A system that controls the leakage of a natural resource.

VKGO includes gas equipment that is privately owned by residents, as well as on the territory of their living space:

  • household appliances connected to gas: stoves, ovens;
  • gas boilers and water heaters;
  • intra-apartment meters;
  • valves, shut-off mechanisms that regulate the flow of gas into the apartment;
  • devices that monitor gas leakage.

Inspection and maintenance of gas equipment in MKD

The operation of gas equipment is carried out in accordance with several legislative acts:

  • RF Resolution No. 549 dated July 21, 2008, which defines the procedure for gas supply;
  • Order of the Ministry of Regional Development No. 239 dated June 26, 2009, which determines the procedure for the maintenance and repair of gas equipment;
  • Resolution of the Government of the Russian Federation No. 410 of May 14, 2013 (hereinafter referred to as Resolution No. 410), which prescribes measures taken to ensure safety during the operation of gas equipment.

Based on the content of these standards, residents of apartment buildings are primarily responsible for the maintenance of gas equipment, but they cannot independently service VDGO / VKGO, therefore they are obliged to conclude an agreement for maintenance and inspection of units with organizations that have the right to do this. Decree No. 410 of the Government of the Russian Federation regulates the following list of mandatory measures necessary to ensure the safety of the use of a gas pipeline, fittings and other equipment in apartment buildings:

  • maintenance of gas equipment in MKD;
  • ensuring the work of the dispatcher and the emergency team;
  • technical diagnostics of gas equipment;
  • replacement of the VDGO / VKGO that has completed the operational period or failed.

Frequency of checks

Gas pipes and other equipment located in public places, as well as on the territory of residents' property, should be checked by a service organization three times a year. In addition, it must service natural resource utilization devices in accordance with the manufacturer's recommendations.

Who has the right to check the equipment

Resolution No. 410 provides a clear description of the main characteristics of a specialized organization with which a contract for the maintenance of VDGO / VKGO can be concluded:

  • it should be an organization that is not necessarily engaged in gas supply, but is engaged;
  • must have permission to exercise the right to maintain and repair VDGO / VKGO;
  • employees of the organization must have specialized education and pass certification for the right to carry out gas hazardous work;
  • re-certification of employees must be carried out once every 5 years;
  • the presence of dispatchers and specialists who go to accidents is mandatory;
  • the organization must have specialized equipment for inspection and testing, the equipment must also be checked and maintained;
  • the presence of measuring instruments is required.

Conclusion of a contract for the maintenance of VDGO

An organization engaged in the maintenance and repair of VDGO has the right to operate only within the framework of the concluded agreement. The customer of the work, as a rule, is the management organization, HOA, ZhSK, TSN, including on behalf of the owners when concluding a contract for the maintenance of gas equipment inside apartments. In the latter case, a protocol must be drawn up by the OSS, in which the owners delegate these powers to the managing organization.

The initiator of the conclusion of the specified contract can be both the customer and the contractor. Consider the procedure and the documents required for provision, when the initiator is the customer.

To conclude a contract, the customer must send a written application to the organization that will perform the maintenance. The application must contain the following information about the applicant:

  • for individuals - full name, residential address, passport data;
  • for organizations - the name, address at which the legal entity is officially registered;
  • information about the location of communications subject to maintenance (MKD address);
  • list of equipment included in the VDGO, VKGO.

The following list of documents must be attached to the application:

  1. A copy of the passport for the owners, a copy of the constituent document for the managing organization, certified by a notary;
  2. OSS protocol, which confirms the right of the Criminal Code, Homeowners' Association, ZhKK to represent the interests of the owners;
  3. The service agreement concluded between the owners and the MA, as well as the OSS protocol, on which the MKD form of government was elected;
  4. A document containing an exact list of the constituent parts of VDGO, VKGO;
  5. Documents confirming the date of sealing the meters;
  6. A copy of the act, which defines the boundaries of the division of the gas pipeline belonging to the common house property and the gas pipeline belonging to the city-wide network.

Works performed under a service agreement

The service organization performs 2 types of work: maintenance of gas equipment outside the MKD and inside it. When carrying out external maintenance, the following work is performed:

  • inspection of communications passing on the external facade of the MKD;
  • the paint layer, pipeline fasteners, cases are checked for damage in the places of the through passage of the gas network through the MKD structures;
  • the connections of pipelines and fittings are examined using a soap emulsion for damage and leakage of a natural resource.

When servicing equipment inside the MKD, the following actions are carried out:

  • the compliance of the existing equipment and the gas pipeline laid in the room with the established standards is checked;
  • the joints on the pipeline and fittings are examined using a soap emulsion for damage and leaks of a natural resource;
  • an audit of gas-using equipment is carried out, the completeness of the composition is clarified;
  • valves are checked for lubrication and the absence of faults, seals are checked;
  • hoods and chimneys are inspected for draft, the pipes connecting the gas equipment and the flue duct are checked for defects, the air flow for combustion is checked.

In accordance with the "Methodological guidelines for the regulation of retail prices for gas sold to the population", approved by the Order of the Federal Tariff Service of the Russian Federation of 23.11.2004. 194-e / 12 and Information Letter of the Federal Tariff Service No. СН-3765/9 dated June 23, 2005, the expenses of gas distribution organizations for the maintenance of VDGO since 2006. were no longer taken into account when approving retail prices for natural gas sold to the population. Thus, retail prices for natural gas sold to the population currently do not include the cost of technical and repair and application services for VDGO, therefore the cost of services (work) for maintenance of VDGO does not depend on the volume of natural gas consumed.

The methodology for calculating the cost of services for the technical operation of VDGO is the same for all specialized organizations that provide these services on the territory of the Russian Federation. The methodology is based on the "Approximate price list for gas facilities services for the maintenance and repair of gas distribution systems", developed by the head research and design institute of the gas industry - JSC "GiproNIIgaz", put into effect by the Order of JSC "Rosgazifikatsiya" dated 20.06.2001. 35.

The cost of services under the contract is determined based on the list and quantity of gas equipment in the house.

Payment for the work performed (services rendered) for maintenance of VDGO and (or) VKGO is carried out by the customer, including in the form of a subscription fee, within the time period stipulated by the contract for maintenance and repair of VDGO and (or) VKGO, and if such a period is not established by the said contract, not later than the 10th day of the month following the month in which the work was performed (services were rendered).

Why do residents of apartment buildings who have chosen the method of managing the management organization pay for the maintenance of the VDGO based on the number of meters of the total area of ​​their living quarters?

In accordance with Article 154 of the RF LC, the structure of the payment for a dwelling for a tenant or for an owner of a room in an apartment building includes, among other things, payment for services and work on the maintenance and repair of common property in an apartment building. VDGO refers to the common property of an apartment building belonging to all owners of premises on the basis of common shared ownership and intended for use by all residents.

The share of each resident cannot be allocated in kind and is proportional to the size of the total area of ​​the premises occupied by the owner, but to the calculation unit of the housing sector, established on the basis of the "Methodological Recommendations for the Financial Justification of Tariffs for the Maintenance and Repair of Housing Stock" (approved by order of the Gosstroy of Russia 28.12. 2000 303), is one square meter of total housing area.

These recommendations were developed by the State Unitary Enterprise "Center for Rationing and Information Systems in Housing and Communal Services" (TsNIS), performing the functions of the Federal Center for Pricing and Tariff Policy in Housing and Communal Services of the Russian Federation, and approved by the Scientific and Technical Council of the Gosstroy of Russia (Protocol 01 -NS-31/4 from 27.10.2000).

Furthermore, in accordance with Art. 156 of the Housing Code of the Russian Federation, payment for the maintenance and repair of residential premises is set in an amount that ensures the maintenance of common property in an apartment building in accordance with the requirements of the law.

According to Art. 158 of the Housing Code of the Russian Federation, the owner of the premises in an apartment building is obliged to bear the costs of maintaining the premises belonging to him, as well as to participate in the costs of maintaining common property in an apartment building in proportion to his share in the common ownership of this property by paying a fee for the maintenance and repair of the residential premises. From which it follows that the payment for a dwelling is made on the basis of the occupied total area (in separate rooms in dormitories, based on the area of ​​these rooms) of the dwelling.

The amount of payment for the use of residential premises (rent), payments for the maintenance and repair of residential premises for tenants of residential premises under social tenancy agreements and agreements for the lease of residential premises of the state or municipal housing stock, as well as for owners of residential premises who have not made a decision on the choice of the method of management of an apartment building are established by local authorities.

Thus, the norms of the current legislation regulate the procedure for charging fees for the maintenance of the VDGO, namely, from one square meter of the total area of ​​the living space. These norms are imperative and do not contain any other option for determining the amount of payment for residential premises.

Why is it worth concluding a comprehensive contract?

The contractor under the contract for maintenance of the VDGO, in any case, is forced to go to the apartments to service the common property, because the first shut-off and control valves at the outlets of the in-house wiring from the risers are located in front of the devices directly in the apartments.

In addition, to the owners (tenants) of apartments in a residential building in accordance with the requirements of the Rules for the supply of gas to meet the household needs of citizens, approved by the Decree of the Government of the Russian Federation of July 21, 2008 No. 549, it will be necessary to conclude individual contracts for the maintenance and emergency dispatching of the VDGO apartment.

The presence of a contract for the maintenance of in-house gas equipment will not release the owner (tenant) of the premises in an apartment building from the obligation to pay for the maintenance of the common property of the house as part of the receipt for payment for the services of the managing organization, which increases the financial burden on the subscriber.

For example, the owner of an apartment with an area of ​​30.5 sq. m must pay the cost of maintenance services for the VDGO, which is part of the common property in an apartment building, in the amount of 30.5 sq. m × 0.96 kopecks. = 29.28 rubles, as well as additionally, within the framework of a separate agreement, the cost of services for technical and repair and application maintenance of in-house gas equipment.

The cost of services under a contract for the maintenance of the gas equipment of an apartment equipped with a four-burner gas stove, a flowing water heater and a household gas meter is 62.90 rubles. per month and consists of the cost:

  • Maintenance of a high-comfort gas stove (equipped with electric ignition, safety automation) - 17.95 rubles,
  • Maintenance of a flow-through automatic water heater - 26.60 rubles,
  • Maintenance of 2 gas taps in front of gas appliances - 11.60 rubles.,
  • Maintenance of threaded connections of a gas pipeline to a gas metering device - 4.20 rubles.
  • Repair and application maintenance of an apartment - 2.55 rubles.

The total monthly payment will be 29.28 + 62.90 = 92.18 rubles.

The calculation was made in prices valid from 01.07.2017.

It is reliably known from practice that 100% of the conclusion of contracts is impossible, while potentially the most hazardous apartments (asocial citizens) will remain without maintenance, which can lead to emergencies that threaten the life and health of not only these citizens, but also their neighbors, since according to statistics, up to 90% of all accidents occur precisely on in-house gas equipment.

In addition, stopping the gas supply without entering the apartment will only be possible by disconnecting the risers in the entrances, including with apartments that have a contract. This will lead to massive blackouts, which will obviously create social tensions. As a consequence, the goal of achieving trouble-free operation will largely be missed.

In order to prevent accidents associated with improper operation of gas equipment, the Government of the Russian Federation adopted a special law, according to which users of this type of fuel are required to regularly check gas equipment located in houses and apartments.

According to the Decree of the Government of the Russian Federation No. 410 of May 14, 2013, citizens who use natural gas to heat their houses and apartments and specialized services need to agree on the conditions for using the resource and conclude appropriate agreements.

Thus, home owners are responsible for their own safety when using “blue fuel”.

That is, the life and health of citizens, in this case, depend on their consciousness. At the same time, they are still thinking whether it is worth signing such an agreement with special gas services.

Of course, everyone has the right to make their own choice. But in this case, the wrong decision will lead to the fact that the gas supply to the concretely taken housing will be terminated. This decision of the gas services will be completely legal.

List of gas equipment subject to inspection

Several types of equipment are used to supply gas to houses and apartments. Each of them must undergo a special test.

At the same time, it does not matter where it is located - in a private house, apartment or is the common property of the residents of an apartment building.

Since there is a division of equipment into general and intra-apartment, it should be clarified what exactly refers to these groups:

  • common house risers are considered to be cranes and metering devices located in apartments;
  • the appliances installed in the apartment are inside the apartment.

Until 2013, the gas equipment available in houses and apartments was under the control of the house's management company. It was the UK that ensured the uninterrupted operation of the devices. The management was also involved in the conclusion of contracts, and the apartment owners themselves had nothing to do with contracts with gas workers.

Any service requires a certain payment. In this case, it was brought in by the residents of the houses. The required amount was recorded in the payment documents.

The delimitation in the responsibilities of the Criminal Code and homeowners appeared immediately after the adoption of the corresponding Resolution of the Government of the Russian Federation No. 410.

Since that time:

  • The following appliances become the private property of apartment owners: gas stoves and boilers, as well as water heaters. That is why the entire responsibility for the correct use and annual verification of these devices is now assigned to homeowners;
  • the management company should deal only with general household appliances and only use them to conclude contracts with gas services.

What organizations serve in-house gas equipment

No other organization other than Gorgaz has the right to provide gas equipment maintenance services to citizens.

To communicate with consumers, the company has its own emergency dispatch service. Companies that have signed contracts with suppliers of the resource and are engaged in its distribution to citizens also monitor the state of gas equipment inside houses and apartments.

Employees of the organization ensuring the uninterrupted and high-quality operation of gas appliances must have special education and regularly undergo certification, which complies with the requirements of the law.

Service contract for VDGO

What is a service contract for indoor gas equipment?

At its core, it is an agreement between the owner of a dwelling and a gas appliance service company. The contract is drawn up according to a certain standard, and also includes a list of services.

The following information is entered into the document:

  • information about the owner of the property, address;
  • the name of the service company, details, account number;
  • what gas appliances are installed in the room;
  • list of services provided by the company in accordance with the concluded agreement;
  • date of conclusion and duration of the contract;
  • cost of services, method of payment.

Note! The amount of payment under the contract depends on the type of gas equipment. Payment is made according to the price list established by the organization and is determined depending on the cost of each device.

How the parties' service agreement works

As soon as an agreement is concluded between the owner and the company, the appliances are checked in the living quarters and repairs are carried out (if necessary).

Types of services and work carried out after signing the contract:

  • check for compliance of the installation of devices with the accepted requirements;
  • monitoring the tightness of pipes and connections between parts of devices;
  • quality control of equipment operation;
  • revision of the draft force of the ventilation outlets;
  • instructing residents using gas appliances.

Note! During the term of the agreement, all work to eliminate resource leakage, as well as to strengthen the tightness of pipes, is carried out free of charge. In the event of any malfunctions, the owner of the home pays for repairs and the cost of parts.

Terms of the contract and the frequency of inspections of gas appliances

The term of the agreement cannot exceed 3 years.

According to this document, the service organization must check the equipment once a year. As a result of the performed procedure, an appropriate act is issued.

How much does VDGO service cost under the contract?

Gas is sold to the population at certain prices. When calculating the retail price, the costs of gas distribution companies for maintenance of gas equipment installed in the house were previously taken into account.

In connection with the Order of the Federal Tariff Service of the Russian Federation dated 23.11.2004 194-e / 12 "On approval of the Methodological Guidelines for the regulation of retail prices for gas sold to the population" and on the basis of the Information letter of the Federal Tariff Service No.CH-3765/9 dated 23.06. 2005, this practice of calculating the price of gas was abolished.

At present, the gas price for residents does not include payment for equipment maintenance services. It follows from this that the cost of maintenance work or services does not depend on the amount of fuel used.

The country has adopted a unified methodology for calculating the cost of VDGO operation services. It is based on the "Sample Price List for Gas Facilities Services for the Maintenance and Repair of Gas Distribution Systems."

This document was developed by JSC "GiproNIIgaz", which is the leading research and design institute of the gas industry. This development of scientists began to operate after the publication of the Order of JSC dated 20.06.2001, No. 35.

The letter of the Federal Tariff Service of the Russian Federation (dated 04/14/2006, 09-153) states that this price list should be used as the main tool in calculating the cost of services for maintenance of VDGO.

The type of gas equipment in a particular dwelling, as well as the number of installed appliances, affects the size of the maintenance fee.

Pay for services or work performed must be the owner of the home who ordered them. The payment term is stipulated by the terms of the agreement.

When the term was not specified in the contract, the next term is taken into account - no later than the tenth day of the month following the month when the corresponding work was performed.

Residents of apartment buildings, where they have their own management companies, pay for maintenance depending on the area of ​​the apartment. Why it happens?

Each house has property that is common to all residents. Maintenance and repair of such equipment falls on the shoulders of the owners or tenants of housing (Article 154 of the RF LC).

It is known that in-house gas equipment is common house property on the basis of the right of common shared ownership, and is also operated by all persons living in this house.

It is impossible to allocate in kind the share of one tenant in proportion to the size of the total area of ​​the apartment. According to the "Methodological Recommendations for the Financial Justification of Tariffs for the Maintenance and Repair of the Housing Stock", approved by the order of the State Construction Committee of Russia No. 303 dated 28.12.2000, 1 sq. M. m. total area of ​​housing.

In our country, the body that performs the functions of the Federal Center for Pricing and Tariff Policy in Housing and Utilities is the State Unitary Enterprise Center for Rationing and Information Systems in Housing and Utilities. It was this company that was engaged in the development of the previously mentioned recommendations.

In 2000, these rules were approved by the Scientific and Technical Council of the Gosstroy of the Russian Federation (protocol 01-НС-31/4 of October 27, 2000). The Housing Code of the Russian Federation (Art. 156) also deals with the calculation of payments for the maintenance and repair of an apartment. It is counted in such an amount that will ensure the maintenance of the common property.

Any apartment owner, in fact, like a tenant, must participate in the maintenance of not only his own home, but also make a certain contribution to ensuring the normal functioning of common house property (Article 158 of the RF LC). This amount depends on the share in the common ownership of the property.

Thus, payment for an apartment is carried out depending on the total area of ​​the apartment (dorm room). Local self-government bodies can establish payments for the use of residential premises.

This happens when tenants use a residential premises on the basis of a social lease agreement for state or municipal premises, as well as if the apartment owners have not decided on how to manage an apartment building.

The procedure for collecting fees for maintenance of intra-house property takes place in accordance with the norms of the current legislation of the Russian Federation. It was already mentioned above that the size of the board depends on the area of ​​the room. These norms are categorical, that is, there are no other ways to calculate the rent.

What is the need for a comprehensive agreement?

The person who is the contractor for the maintenance contract must visit the apartments of citizens. The fact is that the first shut-off and control valves at the outlets of the wiring that goes inside the dwelling are located in front of the gas appliances installed in the apartment.

The rules for the supply of gas to meet the household needs of citizens, approved by Decree of the Government of the Russian Federation No. 549 of July 21, 2008, state that the owners or tenants of apartments are required to sign an individual agreement on maintenance and emergency dispatch support of in-house gas equipment.

Note! If you have entered into an individual maintenance contract, this does not exempt you from the need to pay the appropriate funds for maintenance of indoor gas equipment.

This amount is written on the receipt. It is clear that this only increases utility costs. So, for example, if you own an apartment of 40 sq. m., you need to pay 38.4 rubles for TO VDGO (multiply 40 sq. m. by 0.96 kopecks).

In addition, you still pay the amount specified in your contract for the maintenance of gas equipment installed in your apartment.

Maintenance cost

When the gas equipment of the apartment includes a four-burner gas stove, a water heater with running water, and a gas meter, the monthly payment for maintenance services will be 62.90 rubles.

The cost of maintenance includes:

  • payment for maintenance of the modernized stove (has electric ignition and safety automation) is 17 rubles 95 kopecks;
  • Maintenance of a water heater with running water is 26 rubles 60 kopecks;
