What does a major overhaul mean?

Repair work on the common property of an apartment building of a capital nature usually relates to:

  • Reconstruction of walls (except load-bearing).
  • Separate load-bearing structures.
  • Engineering networks and communications.

Properly planned work should gradually repair the failing parts of the common house property and prevent complete wear of the structural elements of the building.

Parts are either repaired or replaced with analogues or the latest developments. The work is carried out quite rarely, and this is the reason for the not so large amount of the contribution, which usually accumulates for a long time.

Repair can be:

What works are included in the overhaul of an apartment building

You can find out which houses are included in the program for the overhaul of apartment buildings on the website of the administration of your locality. If no improvement work has been done for a long time:

  • you should check if the house is included in the capital renovation program;
  • check the account on which the funds collected for the overhaul are accumulating, perhaps the funds are simply not enough.

Considering what is usually included in the overhaul of an apartment building, what residents can expect in 2017 and subsequent years, we can highlight:

1. Repair of the walls and facade of the building:

  • Painting and coating with insulation of walls, basement and facades of the building.
  • Replacement of glass and loggias of the house with new or light-saving double-glazed windows.
  • General reconstruction of the external appearance of the building, replacement of facing tiles, barriers and waterproofing.
  • Creation of canopies over the basement, entrance rooms and balconies of the upper floors of the house.
  • Repair of the drainage system.

2. Work with the foundation of an apartment building and basement:

  • Reconstruction of the integrity of the foundation.
  • Restoration of the entrance to the basement.
  • More thorough sealing of the junction of the foundation and engineering networks of the building.

3. Roof and attic repairs:

An important feature of the overhaul is that it is aimed at improving or replacing property that belongs to all residents of an apartment building on the basis of common ownership. The money collected from receipts cannot be spent on cosmetic repairs and decoration of private apartments. The only case when this happens is the restoration of the finish in the apartment if it is damaged during replacement when replacing plumbing and pipes.

How is a repair decision made?

In order to conclude that some important elements of the house need major repairs, it is necessary to convene a commission that analyzes the performance of all elements and systems of an apartment building and identifies negative factors that worsen the condition of these elements.

At the same time, an assessment of all elements and structures should be carried out in accordance with the technical passport of the house, the percentage of their wear and tear is indicated.

The general meeting of residents must make a written decision on the need for a major overhaul based on the assessments and expertise received. The meeting decides how such repairs will be financed and what works are included in the overhaul of the apartment building to improve its current condition.

If until 2013 the owners carried out major repairs voluntarily, now the Housing Code has introduced new rules: all regions must adopt special programs, and all owners must make contributions for the major repairs of their homes. They will be reflected in the bills as a separate line.

What documents determine the course of overhaul in the Moscow region?

The course of overhaul in the Moscow Region is determined by two main documents: "On the organization of the overhaul of common property in apartment buildings located in the Moscow Region" and the targeted program "Overhaul of common property in apartment buildings located in the Moscow Region, for 2014 -2038 years”, approved by the government of the region. The program includes all apartment buildings located in the region: the document is accepted for 25 years, during this period the overhaul period is suitable even for new buildings.

How will the order of overhaul be determined?

The Ministry of Construction of the Moscow Region will be responsible for the implementation of the program, as well as determining when which house to repair. In accordance with the year the house was put into operation, the date of the last overhaul (if it was carried out), the technical condition and the percentage of collection of contributions, the houses will be assigned the amount of points. She will determine their place in the queue for overhaul. You can see how the points will be assigned in the Decree of the Government of the Moscow Region dated December 27, 2013 No. 1187/58 “On Approval of the Procedure for Using the Priority Criteria for Capital Repairs of Common Property in Apartment Buildings Located on the Territory of the Moscow Region”, posted on the government website. Priority will be repaired at home, which required major repairs on the date of privatization of the first apartment, but it never happened.

What is included in the list of works?

The program contains a list of overhaul works, which includes the repair of in-house engineering systems, the repair or replacement of elevator equipment, the repair of elevator shafts, foundations, roofs, and basements.

How much will we pay?

The minimum contribution for major repairs is annually set by the regional government. In 2014, it was 7 rubles 30 kopecks per month per 1 square meter of the total area of ​​the apartment, in 2015 - 7 rubles 80 kopecks.

The owners of the premises in the house, which is recognized as emergency, are exempted from paying contributions. It is not economically feasible to repair such houses; they will be included in municipal and regional resettlement programs. Those whose house is located on a plot that has been decided to be withdrawn for state or municipal needs will not pay either.

The line "overhaul" will appear in payment orders from May 1, 2014. Owners themselves can choose how these funds will be accumulated and spent.

In addition to contributions from residents, budgetary funds can be attracted to the overhaul fund. The procedure and conditions for providing state support will be established by the Government of the Moscow Region.

When do you need to choose the method of forming the overhaul fund?

The regional law gives two months after the official publication of the regional program to determine the method of filling the overhaul fund, that is, until April 2014. If the decision is not made, the funds will be automatically accumulated on the account of the regional operator.

At the same time, the regional legislation gave the owners one more opportunity: if the apartment building is not included in the short-term overhaul plan and the repair has not yet been carried out, the owners at the general meeting can decide to stop the formation of the overhaul fund on the account of the regional operator and form such a fund on a special account. They will be able to switch to a special account after 4 months from the date of sending the minutes of the meeting to the regional operator.

The owners must choose a method together, at a general meeting. The decision on choosing the method of forming the overhaul fund will be considered adopted if two-thirds of the votes of the total number of votes of the owners of premises in an apartment building support the decision. If a quorum is not met, the same agenda may be submitted to absentee voting. If the owners themselves did not meet during the first month, the local administration has the right to organize the second meeting.

The law offers citizens a choice: to create a special account for your house to raise funds for major repairs, and subsequently carry out and pay for all the work on their own, or entrust the management of money and repairs to a regional operator.

Pros and cons of a special account

The first way to form a capital repair fund is to transfer contributions to a special account. You can open it in a Russian bank, the amount of capital of which must be at least 20 billion rubles. The list of such banks is published on the official website of the Central Bank of the Russian Federation.

The owner of a special account can be a HOA or a housing cooperative, as well as a management company (since January 1, 2015). Owners whose houses are serviced by management companies can issue a special account on the account of a regional operator. In this case, the functions of the regoperator are reduced simply to opening an account, and according to the law, he does not have the right to refuse this to the owners. The regoperator cannot dispose of the funds of such a special account - this is done by the residents themselves.

The funds of the owners of a particular house are accumulated on a special account - and they can only go to repair it. At the request of any owner, information on the amount of credited payments, on the balance of funds and all operations on this special account must be provided by the owner of the special account and the bank in which the account is opened.

The owners themselves propose and determine the date for the start of repairs, the list and cost of work.

Since the funds on the special account are not the property of the HOA or the regoperator,

if the owner goes bankrupt, incurs fines, or incurs legal costs, the funds in the special account are inviolable. Only the owners of the house have the right to dispose of them.

The owners of the house have full control over the funds on the special account - at the same time, they are fully responsible. It will be necessary to work with the bank, insure the account, look for contractors, check estimates and accept work.

Pluses and minuses of the regoperator

The second option is the transfer of contributions to the account of the regional operator. In the Moscow region, this is the non-profit organization Fund for the Overhaul of Apartment Buildings, it was created by the Government of the Moscow Region, the Board of Trustees of the fund was headed by the Minister of the Construction Complex Marina Ogloblina.

The safety of the regoperator's funds is guaranteed by the budget. For non-fulfillment or improper fulfillment by the regional operator of obligations to the owners, the Moscow Region bears subsidiary liability.

Funds are accounted by the regooperator separately for each owner. Each owner at any time will be able to check how much has been collected, how much and on what types of work has been spent.

The owners do not have to deal with current issues themselves: the regooperator selects banks by competition, accumulates funds, acts as a technical customer, finances the overhaul costs, proposes overhaul proposals to the owners for approval, attracts and controls contractors, etc.

Funds collected from the population cannot be directed to the maintenance of the regoperator, his expenses are paid by the state.

Owners of all apartment buildings, including those with HOAs and housing cooperatives, can choose this method.

The Regoperator has the right to use the funds collected by one house to repair another, who needs repairs earlier. True, such a redistribution is possible only within the framework of one municipality and only on a return basis. The Goszhilinspektsiya supervises the observance by the regoperator of the mandatory requirements of the regional overhaul program.

How to implement a solution?

It is important to remember one more thing: the law prescribes that in two months it is necessary not only to decide where to accumulate money for overhaul, but also to implement this decision.

For “clean” special accounts, it is necessary at the general meeting to decide on the method of managing the overhaul fund, select the bank where the account will be opened, determine the amount of the monthly contribution (it cannot be lower than the minimum), determine the list and terms of work (no less and no later than certain address program). All these issues must be reflected in the agenda of the general meeting. Then you should open an account and, within five days, provide a copy of the minutes of the general meeting, along with a bank certificate on opening a special account, to the State Housing Inspectorate, which maintains a register of special accounts.

To create a special account on the account of the regoperator, it is necessary to send a copy of the minutes of the general meeting to his address.

In order to transfer the management of the overhaul fund of your house to the reoperator, the owners are required to conclude an agreement with the reoperator, and it will be considered concluded if the owner, after receiving the draft agreement, pays a fee to the account of the reoperator.

If the citizens do not make a decision, the administration will transfer the house to the management of the regional operator.

If the house is not in the program?

Do not be alarmed if suddenly you do not see your house in the program. About emergency houses and those that will be affected by the withdrawal for state needs, it was said above. In addition, by decision of the regional Government, houses with less than three apartments, houses with more than 70% physical wear and tear, the total cost of all overhaul works per square meter of total area, may be excluded from the program than the cost determined by the Government of the region.

ON ESTABLISHING THE MINIMUM CONTRIBUTION FOR CAPITAL REPAIRS OF COMMON PROPERTY IN APARTMENT BUILDINGS IN THE TERRITORY OF THE CITY OF MOSCOW

In accordance with Article 167 of the Housing Code of the Russian Federation and Part 2 of Article 7 of the Law of the City of Moscow dated January 27, 2010 N 2 “Fundamentals of the Housing Policy of the City of Moscow”, the Government of Moscow decides:

  1. Establish that the minimum amount of the contribution for the overhaul of common property in apartment buildings in the city of Moscow (hereinafter referred to as the minimum amount of the contribution for capital repairs) is calculated in rubles per square meter of the total area of ​​​​the premises in the apartment building based on an assessment of the need for funds to finance services and (or) work on the overhaul of common property in apartment buildings in the city of Moscow, included in the list of services and (or) work on the overhaul of common property in an apartment building in the city of Moscow.
  2. Establish the minimum contribution for capital repairs from July 1, 2017 in the amount of 17 rubles per square meter of the total area of ​​residential (non-residential) premises in an apartment building per month. The minimum contribution for capital repairs is subject to annual adjustment to reflect changes in the consumer price index.
  1. Approve the list of works and (or) services for the overhaul of common property in multi-apartment buildings in the city of Moscow, the provision and (or) performance of which is financed from the overhaul funds formed on the basis of the minimum contribution for overhaul (attachment).
  2. Install that:

4.1. The decision to determine the method of forming a capital repair fund must be made and implemented by the owners of premises in an apartment building within 5 months after the official publication of the regional program for the overhaul of common property in apartment buildings in Moscow (hereinafter referred to as the regional program), which includes an apartment building , in respect of which the issue of choosing the method of forming its capital repair fund is being decided.

4.1(1). The obligation to pay contributions for major repairs for the owners of premises in an apartment building put into operation after the approval of the regional program and included in the regional program when it is updated arises after 8 calendar months, starting from the first day of the month following the month of the official publication of the legal act of the Government Moscow, which such an apartment building is included in the regional program.

4.2. Measures of social support for certain categories of citizens for paying for housing apply to the payment of contributions for the overhaul of common property in apartment buildings.

4.2(1). A 50 percent discount on the payment of a contribution for the overhaul of common property in apartment buildings, based on the total area occupied by the residential premises owned by citizens, within the social norm of the area of ​​​​the residential premises, is carried out at the expense of the budget of the city of Moscow and is provided:

– disabled people and families with disabled children;

- persons awarded the medal "For the Defense of Moscow";

- persons living in Moscow and continuously working at enterprises, organizations and institutions of Moscow, who did military service in the city from July 22, 1941 to January 25, 1942;

– Citizens awarded with the badge “Honorary Donor of Russia” or “Honorary Donor of the USSR”;

– citizens awarded with the badge “Honorary Donor of Moscow”;

- large families in which three or more children were born and (or) raised (including adopted children, as well as stepsons and stepdaughters) until the youngest of them reaches the age of 16, and students in educational organizations that implement the main educational programs of primary general education , basic general education, secondary general education - until the age of 18;

- families with 10 or more children under the age of 16, as well as over 16 years of age, if they are students of educational organizations that implement the main educational programs of primary general education, basic general education, secondary general education.

4.2(2). Measures of social support for certain categories of citizens for the payment of a contribution for the overhaul of common property in apartment buildings are provided to citizens for no more than one apartment (dwelling) based on the minimum contribution for overhaul established by this resolution.

4.2(3). In the case when the owner of a dwelling has the right to social support measures for paying a contribution for the overhaul of common property in an apartment building on two or more grounds, these social support measures are provided to him on one of the grounds at the choice of a citizen.

The overhaul of common property in apartment buildings is an event prepared in advance in accordance with the work plan, aimed at the qualitative renewal of all communications, carrying out other work and taking measures aimed at improving the quality of life of the owners of premises in a particular building.

The following list of works on major repairs of buildings and structures can be attributed to the activities related to the capital form:

  • restoration of the waterproofing layer on the roof, and in places where this is required by the current state, complete replacement of the roofing;
  • replacement of all necessary communications belonging to common houses;
  • reconstruction of the facade of the building or its replacement (if necessary);
  • the same actions, but performed in relation to the foundation;
  • repair of elevator mechanisms (in cases where these measures are justified from the point of view of the safety of citizens using these mechanisms);
  • replacement of window structures and door blocks;
  • plastering, whitewashing and painting the walls and ceilings of the entrances, as well as all common areas that are classified as common property and included in the estimate for the performance of work.

The same works are given in Appendix No. 8 to the Rules and Norms for the Technical Maintenance of the Housing Stock dated September 27, 2009 No. 170.

This list of works is not exhaustive and can be supplemented if additional items have been agreed with the organization performing the work.

Now that you know what types of work are included in the overhaul of an apartment building, let's talk about the list of services and works for the overhaul of common property in an MKD and what it may have in common with the current one.

What works can be performed both in capital and current repairs?

If we turn to the above articles and analyze the list of works that is presented in the overhaul, comparing it with a similar list from the current one, we can see that there is still a similarity in the work performed.

And what works relate to the overhaul of an apartment building and to the current one?

So, both during the current and during the overhaul, the following activities can be carried out:

  1. Restoration of waterproofing roofing, if necessary.
  2. Insulation of buildings by working on facades (their insulation and painting can be carried out both during current repairs and during major repairs, if required by the operating conditions of the building).
  3. Partial or complete replacement of door blocks and window frames, as well as restoration of lost glazing.
  4. Cosmetic repair of entrances with the elimination of violations of paint and varnish coatings and plaster.

In general, both the scope of work on the overhaul of apartment buildings and for the current one is formed individually for each specific apartment building by making a joint decision between the homeowners and the organization hired to carry them out.

By the way, in the regions there are special programs for major repairs, within the framework of which repairs are carried out on buildings and structures in cities and towns. The sequence of work determines the list of the regional capital repair program, which can be found in local governments.

Influence of operating conditions of an apartment building

The rules and regulations for the operation of the housing stock in a separate section consider the special conditions for the operation of various buildings intended for human habitation.

Particulars of the operation of buildings located in different territories are entirely devoted to Section No. 6, which discusses the conditions for the use and, accordingly, maintenance of residential premises located on salty soils, in a zone of increased seismic activity, permafrost, etc.

Despite the fact that Appendix No. 8 to these Rules does not fix exactly how operating conditions affect the ongoing repair work, Section 6 contains a direct list of possible violations of the norms for the use of apartment buildings, which must be eliminated during the overhaul.

So, in accordance with Art. 6.2.2, if the building is located on the so-called subsiding soils, that is, there is a very high risk due to the very light and porous structure of the shrinkage of the house, with each repair, all engineering communications must be checked for possible leaks.

With a major overhaul, all communications must be replaced with high-strength materials. Special locking mechanisms should be installed on water supply networks to stop the water supply in the event of a leak (clause B of Art. 6.2.15).

In seismically active zones, during any repair work, partitions should be installed with a wooden frame fixed in the walls of the room (Art. 6.5.5).

After each fact, even minimal seismic activity in accordance with Art. 6.5.10 it is necessary to conduct inspections of the technical condition of buildings with the subsequent drawing up of an inspection report.

It is on the basis of such an act that a decision will be made to carry out current or major repairs. And in the process of performing repair work, it is necessary to strengthen structures that ensure the stability and safety of buildings.

When carrying out repair work in any type of buildings operated in permafrost areas, special attention should be paid to the control, and, if necessary, to the complete repair of the drainage system, as well as sidewalks and slopes of houses in order to prevent water from entering the foundation, as well as freezing especially designed to ensure the stability of talik buildings located in foundations (Art. 6.6.7, 6.6.12).

Capital repairs of water supply and sewerage networks should be carried out not once every 25 years, but with the frequency that will be necessary to prevent the creation of a probable emergency due to emerging leaks.

Thus, the overhaul of any apartment buildings is a rather complicated event, requiring compliance with a number of technical requirements for the work performed.

As for the territories in which the conditions for the operation of the housing stock are especially difficult, there are increased requirements for the work on the overhaul of buildings and their utilities.

In accordance with Article 166 of Federal Law No. 271-FZ of December 25, 2012 (the so-called overhaul law), the list of major repairs of apartment buildings includes the following activities:

  1. Repair of intra-house systems of energy, heat, gas, water supply and sanitation.
  2. Repair or replacement of elevators and lift shafts.
  3. Roof repair and conversion of a non-ventilated roof into a ventilated one.
  4. Basement renovation.
  5. Repair and strengthening of the facade of an apartment building.
  6. Installation of general joom meters for heat, gas, water, electricity. As well as the installation of control nodes for the consumption of these resources.
  7. Foundation repair.

Also, local regional authorities may decide to supplement the above list of works on the overhaul of the Moscow Ring Road. However, the residents themselves, when an appropriate decision is made at a general meeting of residents of an apartment building, have the right, with an increase in the minimum contribution for overhaul in their house, due to such an excess of contributions, to send them to any major repairs of the house.

In other words, local authorities approve the list of major repairs in a particular apartment building. This list can be expanded with additional funds received either from contributions from the owners or from additional financing from the overhaul fund. However, in the second case, this requires the decision of local authorities. Therefore, if residents want to carry out additional work on the overhaul of apartment buildings financed from the overhaul fund, and not from their own funds, they must contact the local authorities with justification for such a need.

The works themselves are carried out in accordance with the terms approved by the apartment building. At the same time, the residents of the house can again, at the general decision of the meeting of the owners of the MKD, decide on earlier terms for the overhaul.

The procedure for choosing a contractor for each type of work on the overhaul of an apartment building depends on the scheme chosen by the owners of the premises in the house to form the overhaul fund (on the account of the regional operator or on a separate special account of the house). If residents have chosen the form of accumulation of funds in the form of a “common pool” on the account of a regional operator, then he will attract contractors for the work. The regional operator in this case will be responsible for the quality of the overhaul work to the residents. If residents pay to a special account at home, then the firm that performs the work will be directly responsible for the quality and timing.
