1. The Ministry of Fuel and Energy of the Russian Federation (Ministry of Fuel and Energy of Russia) is the central body of the federal executive power, which manages the functioning and development of the fuel and energy complex of the Russian Federation, as well as coordinates the activities of independent enterprises and organizations of the electric power industry, oil production, oil refining, gas, coal, shale and the peat industry, gasification and gas supply of the gas economy, the oil product supply system and main oil, gas and oil product pipelines, specialized machine-building, construction, scientific, design and other enterprises and organizations (hereinafter referred to as enterprises of the fuel and energy complex) on issues related to its maintenance.

2. The Ministry of Fuel and Energy of Russia in its activities is guided by the Constitution of the Russian Federation, the Law of the Russian Federation "On the Council of Ministers - the Government of the Russian Federation" and other legislative acts of the Russian Federation, decrees and orders of the President of the Russian Federation, decisions and orders of the Council of Ministers - the Government of the Russian Federation, as well as by these Regulations.

3. The Ministry of Fuel and Energy of Russia carries out its activities in cooperation with other central federal executive bodies.

4. The Ministry of Fuel and Energy of Russia carries out its work on the principles of close interaction with the executive authorities of the republics within the Russian Federation, territories, regions, autonomous formations, cities of Moscow and St. Petersburg in order to coordinate and take into account the interests of the fuel and energy industries and regions, and assists these bodies in the restructuring of the fuel and energy complex, the creation of new jobs, the development of industrial and social infrastructure.

5. The main tasks of the Ministry of Fuel and Energy of Russia are:

development and implementation in accordance with the current legislation of the state policy in the fuel and energy complex of the Russian Federation;

meeting the needs of the national economy and the population in various types of energy, their rational and safe (in environmental and technological terms) use and savings in all spheres of consumption;

ensuring the efficient and sustainable functioning of the fuel and energy complex;

organization of the development of the main directions for the development of the fuel and energy complex;

participation in the development and implementation of state policy for the formation of market relations based on the development of a competitive environment, changes in property relations in the fuel and energy complex, implementation of sectoral demonopolization programs;

expanding the participation of the fuel and energy complex in solving macroeconomic problems of Russia, integrating its economy into the world economic space, increasing the efficiency of export of fuel and energy resources, promoting the attraction of foreign investments in the development of the complex, encouraging investment activities abroad of enterprises of the fuel and energy complex, using in the interests of the national economy of the possibilities of international organizations of the fuel and energy profile;

implementation of state regulation of the activities of enterprises of the fuel and energy complex by organizing the development, approval in accordance with the current legislation of regulatory and technical acts, standards, norms and rules in the field of organizing the operation, repair and construction of enterprises of the complex and monitoring their observance;

decision, in agreement with the state authorities and administrations of the constituent entities of the Russian Federation, local self-government bodies, on the placement and construction of large enterprises of the fuel and energy complex.

6. The main functions of the Ministry of Fuel and Energy of Russia are:

development of proposals for the formation and participation in the organization of the implementation of sectoral demonopolization programs, state targeted scientific and technical programs for the creation of new energy technologies and equipment, solving energy conservation problems, introducing highly efficient, environmentally friendly and reliable technological processes, including on the basis of the conversion of defense and machine-building complexes;

development and implementation of state policy in the field of design and construction of enterprises of the fuel and energy complex;

ensuring state energy supervision, state control and supervision over the rational use of oil, gas and their processed products, over the quality of peat in all spheres of the economy of the Russian Federation, as well as state supervision over the objects of the fuel and energy complex in terms of ensuring the safety of navigation, underwater technical works , operation of hydraulic structures and prevention of oil pollution of the aquatic environment;

ensuring measures to comply with the requirements for the protection of subsoil and other natural resources in the implementation of a complex of economic activities by enterprises;

coordination in accordance with the current regulation on licensing of the procedure, terms and conditions for the involvement in the development of existing and newly discovered oil, gas and coal deposits;

participation in the establishment of the main technical and economic indicators of oil, gas and coal production for the presentation of licenses and in the control over the fulfillment of the stipulated conditions for the development of deposits under valid licenses, as well as in the examination of calculations justifying the amount of recoverable oil, gas and coal reserves;

ensuring organizational, technical and economic conditions for increasing the environmental and technological safety of operating enterprises and compliance with environmental and operational standards of newly commissioned and reconstructed enterprises;

development of proposals for demonopolization, socio-economic development, effective implementation of price, investment, tax, concession policies, implementation of scientific and technological progress, ensuring the reliability, sustainability, efficiency and safety of the fuel and energy complex enterprises; credit and financial regulation of the functioning and development of the complex;

development of proposals on legislative and normative acts regulating the activities of the fuel and energy complex, participation, together with interested organizations, in the coordination, implementation and control of the implementation of legislative and regulatory acts on the fuel and energy complex;

participation in improving the economic mechanism for regulating the work of enterprises of the fuel and energy complex in the context of the transition to market relations; preparation, jointly with interested organizations, of proposals for the creation and regulation of economic and legal foundations for the development of market relations, direct commercial relations aimed at sustainable provision of the national economy and the population of the Russian Federation with fuel and energy, as well as reliable material and technical supply of the enterprises of the complex;

development of proposals for the formation of tariffs, prices, subsidies for fuel and energy resources and other products of the sectors of the complex;

organization and coordination of the fulfillment of obligations under interstate agreements of the Russian Federation concerning the issues of the complex's activities;

assistance in attracting foreign investors in accordance with the established procedure for the development of sectors of the complex and increasing their export potential; rendering assistance to the enterprises of the complex in the implementation of foreign projects;

participation in the development and implementation, together with the Ministry of Foreign Affairs of the Russian Federation, the Ministry of Foreign Economic Relations of the Russian Federation and other central bodies of federal executive power, of state policy in the field of export-import operations;

creation, in accordance with the established procedure, of off-budget sectoral funds for financing capital construction, research and development work, insurance and others;

creation, in accordance with the current legislation, of a foreign exchange fund for the purchase of equipment and materials for general industry purposes;

preparation and organization of the implementation of proposals for the establishment of quotas for export-import operations on the range of products of the fuel and energy complex, participation in the formation and distribution of quotas for the transfer of oil, gas, coal and their processed products and electricity from Russia, bringing quotas to the producers of these products in accordance with with the established order;

interaction with enterprises of the fuel and energy complex in order to create conditions for the safe operation of production facilities, working conditions in the sectors of the complex, the introduction of new means and methods for the prevention of occupational diseases, industrial injuries and accidents, development and approval in agreement with the relevant bodies (including trade union) industry rules and norms and control over their observance;

organization, coordination and control jointly with the State Committee of the Russian Federation for Civil Defense, Emergencies and Elimination of the Consequences of Natural Disasters; implementation of measures aimed at preventing and eliminating the consequences of emergencies in the fuel and energy complex of Russia, the introduction of mobilization training, the implementation of civil defense measures ; provision of reliable protection of state secrets, other classified information and special communication, implementation of methodological guidance in the indicated areas of work on the basis of unified national legislative and regulatory acts;

provision of methodological guidance for the activities of geological and mine surveying services of mining enterprises;

implementation through the sectoral control system of measures to ensure the safety of work and the protection of subsoil, the implementation of the relevant legislative acts at the enterprises of the complex;

creation, provision of technical guidance and control over the activities of mountain rescue units and detachments, as well as militarized security units that are part of the fuel and energy complex, and approval of their locations in accordance with the established procedure;

coordination of the work of departmental and professional emergency rescue units that are part of the Russian system of warning and action in emergency situations, during emergency rescue and other urgent operations;

management of the creation, readiness and operation of the departmental subsystem of the Russian warning and emergency response system in accordance with the functions assigned by the Council of Ministers - the Government of the Russian Federation to the Ministry of Fuel and Energy;

participation in the implementation of a unified state policy in the field of personnel formation, employment, social protection of workers, pension provision, development of labor relations based on social partnership, prevention and resolution of labor conflicts, youth and migration policy;

organization of training, retraining and advanced training of personnel for enterprises of the fuel and energy complex; exercise, within the limits of the competence and authority established by the legislation, of the management of the sectoral system of educational institutions;

provision of methodological assistance to enterprises of the fuel and energy complex in the implementation of state social insurance and compulsory insurance against industrial accidents and occupational diseases, organization of a complex of medical and preventive care at enterprises, participation in the preparation of proposals for improving preferential pension provision;

assistance in the development and regulation of inter-republican, regional economic relations of enterprises of the complex with consumers of the complex's products and suppliers of material and technical resources on the basis of business partnership and economic interest;

performing the functions of a general supplier in relation to fixed objects being built abroad with the technical assistance of the Russian Federation;

analysis of the production and economic activities of enterprises of the fuel and energy complex with the provision of constant information flows for the implementation of state regulation in the prescribed manner;

development of proposals to stimulate an increase in labor productivity and efficiency, a mechanism for social protection and recommendations on the organization of remuneration for employees of enterprises of the fuel and energy complex, participation in the development, conclusion and implementation of sectoral (tariff) agreements in accordance with the current legislation;

organization of fire prevention works aimed at ensuring reliable and trouble-free operation of enterprises of the fuel and energy complex;

7. The Ministry of Fuel and Energy of Russia to perform the tasks and functions assigned to it:

forms a unified strategy for scientific and technical, industrial and technical and socio-economic development of the fuel and energy complex;

with the involvement of other ministries, departments and sectoral enterprises (joint-stock companies) develops a strategy for the development and use of hydrocarbon resources, the fuel and energy balance of the Russian Federation by type of fuel and specific consumers, organizes and coordinates the actions of sectoral enterprises (joint-stock companies) aimed at ensuring reliable and sustainable supply of the national economy and the population with fuel, heat and electric energy, concludes, on behalf of the Council of Ministers-Government of the Russian Federation, production contracts with enterprises of the complex;

jointly with other interested federal executive bodies develops the main directions of state policy in the field of energy conservation, coordinates the most important work to improve the efficiency of energy use in the national economy and takes part in the preparation of proposals for their financing (the paragraph was additionally included by the Decree of the Government of the Russian Federation of November 2, 1995 N 1087);

submits proposals to the Council of Ministers - the Government of the Russian Federation with the involvement of other ministries and departments for the implementation of state programs in the field of fuel and energy supply: on financial, credit and economic issues, including a draft budget application for financing the activities of the fuel and energy complex, on development of measures to stimulate an increase in labor productivity and efficiency, on the mechanism of social protection, on the organization of remuneration for employees of enterprises of the fuel and energy complex, on the regulation of labor relations in the sectors of the complex and other issues of the activity of the fuel and energy complex in accordance with the current legislation;

creates an information bank of data of the fuel and energy complex of the Russian Federation on the basis of information received from the enterprises of the complex, and submits information to the federal economic authorities on the basis of established statistical reporting;

creates and develops the means and systems of production, technical and information communication of the branches of the fuel and energy complex;

acts on behalf of the Council of Ministers-Government of the Russian Federation as a customer when placing in the established procedure orders for the supply of products, production of work (services) for state needs at the enterprises of the complex and providing these enterprises with the necessary resources together with the Ministry of Economy of the Russian Federation, Ministry of Finance of the Russian Federation and other interested organizations;

concludes contracts with the heads of state-owned enterprises in federal ownership and approves the charters of such enterprises when delegating these functions to the Ministry of Fuel and Energy of Russia by the State Committee of the Russian Federation for State Property Management;

on behalf of the State Committee of the Russian Federation for State Property Management gives opinions on draft decisions on the creation, reorganization and liquidation of federal-owned fuel and energy complex facilities, and also develops proposals for recommendations on taking into account the specifics of industry enterprises taken into account during privatization and exercising powers owner;

participates in the examination of projects and estimates for the construction of large enterprises of the fuel and energy complex of inter-industry importance, as well as the most significant scientific and technical developments for the implementation of the tasks facing the complex;

submits candidates to the State Committee of the Russian Federation for State Property Management, the Russian Federal Property Fund, property management committees and the property fund of national-state, national-territorial and administrative-territorial entities to attract them in the prescribed manner to the exercise of the powers of the state as the owner of enterprises ( shares in the authorized capital) as representatives of the said bodies;

determines, jointly with industry enterprises (joint-stock companies), the procedure for managing energy product pipelines and the federal energy system;

receives from the State Committee of the Russian Federation on statistics and enterprises of the fuel and energy complex statistical data on issues related to the competence of the Ministry of Fuel and Energy of Russia;

confers industry honorary titles to the best workers, as well as awards, in accordance with the established procedure, the advanced workers of the complex branches with appropriate badges, certificates of honor;

convenes in the prescribed manner conferences and meetings, organizes exhibitions on the problems of improving and developing the activities of the sectors of the complex.

8. The Ministry of Fuel and Energy of Russia is headed by a Minister appointed by the President of the Russian Federation.

The Minister has deputies appointed by the Council of Ministers by the Government of the Russian Federation. The distribution of duties between the Deputy Ministers is made by the Minister.

9. Minister of Fuel and Energy of the Russian Federation:

manages the activities of the Ministry on the basis of one-man management;

bears personal responsibility for the implementation of the tasks and functions assigned to the Ministry, establishes the degree of responsibility of the Deputy Ministers and members of the collegium, heads of the structural divisions of the Ministry;

issues, within the limits of its competence, orders, instructions and gives instructions that are binding on subdivisions of the central office, as well as by enterprises of the fuel and energy complex;

approves, within the established number and wage fund of employees of the structure and the staffing table of the central office of the Ministry, the regulation on its structural divisions, as well as the cost estimate for the maintenance of the central office within the appropriations approved for the corresponding period.

10. In the Ministry of Fuel and Energy of Russia, a collegium is formed consisting of the Minister (chairman of the collegium), his deputies, heads of the leading departments of the Ministry and enterprises, approved by the Council of Ministers - the Government of the Russian Federation.

The Ministry of Fuel and Energy of Russia at regular board meetings considers issues of the activities and functioning of the fuel and energy complex. The decisions of the board are enforced by orders of the Ministry.

11. The Ministry of Fuel and Energy of Russia is forming a scientific, technical and economic council with sections on specific problems. The personal composition of the Scientific, Technical and Economic Council and the regulations on it are approved by the Minister of Fuel and Energy of the Russian Federation. The organizational and technical support for the work of the council is carried out by the central office of the Ministry.

12. The Ministry of Fuel and Energy of the Russian Federation is a legal entity, has a seal depicting the State Emblem of the Russian Federation and with its own name, current and other accounts in bank institutions.

13. The expenses for the maintenance of the central office of the Ministry of Fuel and Energy of Russia are financed from the funds of the republican budget of the Russian Federation, allocated for the maintenance of the central bodies of the federal executive power of the Russian Federation.

14. The Ministry of Fuel and Energy of Russia is located at the address: Moscow, Kitay proezd, house 7.

Ministry of Energy of the Russian Federation (Ministry of Energy of Russia) - the federal executive body of Russia, exercising state administration in the field of energy and under the jurisdiction of the Government of the Russian Federation.

Story

In 1991, after the collapse of the USSR, state-owned energy enterprises were privatized and transferred to private ownership. The Union Ministry was liquidated, the republican ministry was transformed into Ministry of Fuel and Energy of the Russian Federation, later transformed into the "Ministry of Industry and Energy of the Russian Federation" (until May 12, 2008). After the privatization of state-owned enterprises, ministries perform the functions of consulting, monitoring, control and supervision.

Ministry of Energy of Russia (2008)

It was formed on May 12, 2008 by the Decree of the President of the Russian Federation No. 724 through the separation of the Ministry of Industry and Energy of the Russian Federation. The Ministry of Energy of the Russian Federation develops and implements state policy in the industry and legal regulation of the fuel and energy complex, including the issues of electric power, oil and oil refining industries, gas, peat, coal and shale industries, products of their processing, renewable energy sources , the development of hydrocarbon deposits on the basis of production sharing agreements and in the petrochemical industry, as well as law enforcement functions and functions for the provision of public services, for the management of state property in the production and use of fuel and energy resources.

The Ministry of Energy of the Russian Federation is guided in its activities by the Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as the Regulations on the Ministry of Energy of the Russian Federation.
