1. On the activities of online stores in the Russian Federation.

Article 26.1 of the said Law (Article 26.1 was introduced into the Law by the Federal Law of the Russian Federation of December 21, 2004 No. 171-FZ, which entered into force on January 9, 2005) establishes that a retail sale and purchase agreement can be concluded on the basis of familiarization a consumer with a description of the goods proposed by the seller through catalogs, brochures, booklets, photographs, means of communication (television, postal, radio communications and others) or in other ways that exclude the possibility of direct acquaintance of the buyer with the goods or its sample when concluding an agreement (remote method of selling goods).

Internet commerce belongs to this category, since when ordering a product via the Internet, the buyer does not have the opportunity to directly familiarize himself with the product itself or its sample.

Regulation of this type of trade is carried out on the basis of the Rules for the sale of goods by remote means, established by Decree of the Government of the Russian Federation of September 27, 2007 No. 612. The norms of the above legislative acts apply without restrictions to the purchase and sale of goods through online stores.

The sale of goods through the online store takes place on the basis of a retail sale and purchase agreement concluded between the seller of the goods and the buyer. In accordance with paragraph 2 of Art. 432 of the Civil Code of the Russian Federation, such agreements are concluded by sending an offer (proposal to conclude an agreement) by one of the parties and its acceptance (acceptance of the offer) by the other party. Proposals containing all the essential terms of the contract, which can be accepted by anyone who responds, are recognized as a public offer in accordance with Art. 437 of the Civil Code of the Russian Federation.

Similarly, the offer of goods on a website on the Internet, addressed to an indefinite circle of persons, is recognized by the current legislation of the Russian Federation as a public offer (clause 1, article 494 of the Civil Code of the Russian Federation), if such an offer contains all the essential terms of the retail sale contract (name of goods, price per unit of goods, direct offer for the purchase of goods).

In accordance with the all-Russian classifier of types of economic activity OK 029-2001, approved by the Resolution of the State Standard of November 6, 2001 No. 454-st, the sale of goods via the Internet is retail trade carried out through tele-shops and computer networks (OKVED code 52.61 .2).

Online stores must provide the following information on the website in a form accessible to the consumer:

  • offer (conditions for the sale of goods)
  • a set of information for consumers (observance of rights to information about the product, manufacturer, seller), certificates, technical documentation, etc., copies of licenses (if the activity is subject to licensing).

The seller's obligations to transfer the goods to the buyer arise from the moment he receives the corresponding message from the buyer about his intention to conclude a contract for the purchase of goods (acceptance).

The acceptance of the buyer is an application in which the potential buyer of the goods must indicate the following:

  • the name and address of the seller,
  • your last name, first name and patronymic (or another person who is the recipient of the goods),
  • the address to which the goods are to be delivered,
  • name of the product, article number, brand, variety, number of items included in the package of the purchased product, price of the product,
  • type of service (when provided), time of its execution and cost,
  • buyer's obligations.

The online store (seller of the goods) is obliged to deliver the goods to the place indicated by the buyer within the time period established by the contract, and if this is not named, to the place of residence of the citizen (clause 1, article 499 of the Civil Code of the Russian Federation). In order for the retail sale contract to be considered fulfilled, it is not necessary to transfer the goods directly to its buyer. In the absence of a buyer, the goods may be transferred to any person who has presented a receipt or other document evidencing the conclusion of an agreement or the delivery of goods (clause 2, article 499 of the Civil Code of the Russian Federation).

Ownership rights to the goods under contracts that include the condition of their delivery by the seller are transferred from the seller to the buyer at the time of delivery of the goods to the buyer.

The possibilities for the consumer to refuse the goods are specified in paragraph 4 of Art. 26.1 of the Law "On Protection of Consumer Rights". The buyer has the right to refuse the goods at any time before its transfer, and after the transfer of the goods - within 14 days.

Return of goods of proper quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified goods are preserved. The consumer's lack of a document confirming the fact and conditions of the purchase of goods does not deprive him of the opportunity to refer to other evidence of the purchase of goods from this seller.

At the same time, the consumer does not have the right to refuse goods of appropriate quality, having individually defined properties, if the specified product can be used exclusively by the consumer who purchases it.

If the consumer refuses the goods, the seller must return to him the amount of money paid by the consumer under the contract, with the exception of the seller's expenses for the delivery of the returned goods from the consumer, no later than thirty days from the date the consumer makes the relevant request (if necessary, an examination - within 40 days ).

In case of exchange and return, the cost of delivery is paid by the Client. If you received a poor-quality product or you were not delivered what was ordered, the cost of the return is paid by the online store.

In the event of disputes over the quality of the goods or the reasons for the occurrence of defects in the goods, the seller accepts the goods of inadequate quality from the buyer and conducts an examination. The buyer has the right to participate in checking the quality of the goods and challenge the conclusion of the examination in court.

2. Basic provisions

2.1. This Agreement is concluded between the Buyer and the online store at the time of placing the order. The Buyer confirms his agreement with the conditions established by this Agreement by making an application for the purchase of goods when placing an order or registering on the Site.

2.2. These Agreements, as well as information about the product presented on the Site, are a public offer in accordance with Article 435 and Part 2 of Article 437 of the Civil Code of the Russian Federation.

2.3. The relations between the Buyer and the Online Store are subject to the provisions of the Civil Code of the Russian Federation on retail sale and purchase (§ 2 Chapter 30), as well as the Law of the Russian Federation “On Protection of Consumer Rights” dated February 7, 1992 No. 2300-1 and other legal acts adopted in accordance with with them.

2.4. The buyer can be any individual or legal entity capable of accepting and paying for the goods ordered by him in the manner and on the terms established by this Agreement.

2.5. The online store reserves the right to make changes to this Agreement without notice.

2.6. This Agreement shall be considered in the form as it is published on the Site and shall be applied and interpreted in accordance with the laws of the Russian Federation.

3. Product Information and Warranty

3.1. At the request of the Buyer, the manager of the online store is obliged to provide (by phone, via Skype or by e-mail) additional information necessary and sufficient, from the point of view of the Buyer, for him to make a decision to purchase the goods.

3.2. The price of the goods indicated on the Site is a reference and can be changed by the online store unilaterally without prior notice.

3.3. In the event of a change in the price of the goods ordered by the Buyer, the manager of the online store immediately informs the Buyer about this (by phone, via Skype or by e-mail) in order to receive confirmation or cancel the order. If it is impossible to contact the Buyer, this order is considered canceled.

3.4. The invoice issued to the Buyer is valid for 3 business days.

3.5. For all products available in the range of our online store, a guarantee is provided - 2 weeks (14 days) from the date of receipt of the order, or an extended warranty for a longer period, if it is specifically agreed for this product.

3.6. The online store assumes responsibility for all defects of the goods, with the exception of those that arose as a result of the buyer's violation of the rules for using, storing or transporting the goods and through the fault of third parties. If your product turned out to be defective and, despite careful handling, became unusable during the first two weeks of use, please let us know by mail. We will exchange your product for an identical one, and if this model is not in stock, for an item of equal value, or we will refund your money.

4. The procedure for purchasing goods

3.1. The buyer has the right to place an order for any product presented on the Site. Each item can be ordered in any quantity. The order can be placed by the Buyer in the following ways: made by phone, by e-mail or placed independently on the Site.

3.2. After placing an order through the Site, a letter is sent to the Buyer's e-mail confirming the acceptance of the order, indicating the names of the selected goods and the total amount of the order, which is an integral part of this Agreement.

3.3. If the goods are not in stock, the manager of the online store is obliged to inform the Buyer about this (by phone or by e-mail) and inform the possible delivery time of the goods.

3.4. The buyer has the right to make a preliminary order for a product temporarily out of stock, replace it with another product, or cancel the order.

3.5. The Buyer has the right to refuse the ordered goods at any time before it is sent to the Buyer, or at the time of receipt from the courier until payment.

4. Delivery of goods, terms

4.1. Delivery of goods ordered in the online store, in the agreed quantity and assortment, is carried out by a courier service or a transport company.

4.2. The cost of delivery of the goods is paid by the buyer in accordance with the choice of delivery method.

4.3. The maximum delivery time for the goods to the Buyer's address, from the moment the payment for it is received to the current account, is for the regions from 3 to 45 days (delivery time is specified upon purchase). For Moscow and the Moscow region, the delivery time is from 1 day, but not more than 7 days.

5. Payment for goods

What are they made from?

The brush seal (flash) is an ordinary brush, the villi of which are made of a wide variety of materials, depending on the flooring, window sill material, and their operating conditions.

Most often, for the manufacture of brush seals, synthetic fibers are used: nylon, polyethylene, silicone, synthetic rubber, natural bristles or metal wire.

The basis for its manufacture can be polymeric woven materials, rigid bases - plastic, rubber, metal.

Usually, the accessory is mounted at the bottom of sliding plastic doors (windows) blocking the gap formed at the bottom of the door with the upper location of the rollers on which the canvas slides. When it is used for "French" windows that do not have a plastic frame, it can be located around the entire perimeter of the glass, be transparent (silicone) acting as a flashing.

What is it used for?

Most designs of sliding plastic doors (windows), with rare exceptions (lifting-sliding - as in buses), do not provide an absolutely tight fit of the leaf to the door (window) frame, it becomes necessary to partially eliminate this drawback.

The use of traditional rubber (silicone) seals is impossible due to the high coefficient of friction of these materials and rapid failure, difficulty in opening doors, and damage to the flooring. Quite another matter is a soft, dense, multi-row brush that easily glides over any surface, blocking the resulting gap.

But the brush does not guarantee insulation, getting rid of odors if the structure is installed in the kitchen, from frost and drafts, if a French window leading to the terrace is equipped with such a flashing. But the flashing will reliably protect the room from the penetration of dust, insects, raindrops knocking on the window.

Depending on whether brush seals are used on plastic or wooden sliding doors - external, leading to the street or internal - interior, the structure, height, thickness of the material from which they are made differ.

For external street brush seals used for insulation, porous rubber is used, which has a very low thermal conductivity. Due to the large width of the strip, several rows of bristles, their tight fit to each other, it provides quite effective protection against heat loss in the room and insulation.

When brush strips are used in interior sliding wooden structures, or for closets, where the main purpose of use is not to insulate, but to prevent dust from entering (flashes). They do not have such a dense structure (2-3 rows of tufts of bristles).

Brush strips differ in design. For wooden, metal sliding - often made on an adhesive basis, which allows you to quickly mount, if necessary - just as quickly replaced.

For plastic sliding windows, the bristles are mounted on a metal frame with a profile section, which is simply inserted into the corresponding groove of plastic products. For each manufacturer of doors (windows), only its "branded" profile is used. These items are not interchangeable.

For glass sashes, silicone (transparent) brush seals are used, which have a U-shaped profile, put on the end of the glass, previously degreased and moistened with water.

When dry, they are firmly fixed.

Summing up

The use of brush seals is a necessary measure, which is caused by the imperfection of the design of plastic windows, when cheap designs are used that do not provide for complete sealing. They do not prevent heat loss, drafts, or the spread of odors. But they effectively cope with the task of protecting the premises from dust, the penetration of insects from the street. The use of such an accessory is permissible only on verandas, terraces that are not heated. If you use them to insulate warm rooms, this will lead to an unjustified overexpenditure of thermal energy due to high losses through a loose structure.

A brush seal for doors (schlegel) is used to eliminate gaps and dampen the closing and opening of the wings. This useful element is most often installed by the manufacturer. In the absence of it, it is advisable to do it yourself.

Brush seals for doors, or flashings, have differences in the bases, which are produced with an adhesive layer and without adhesive application. They are made of polymeric materials, plastic, metal.

The brush seal is used more often for sliding doors, roller and sectional doors, windows, wardrobes. A characteristic quality of these designs is the loose closure they provide. When installing this hardware provides:

How to choose

To select fittings, it is enough to know what structure it will be attached to and what size gap needs to be eliminated. In window and some types of door panels, the buffer tape is inserted into the corresponding groove.

It is recommended to glue fittings with a frequent and short pile coating on the ends of the wings of sliding wardrobes and doors. The color is selected in accordance with the interior.


How to attach with your own hands

If there is no door seal, you must install the brush seal yourself. Installing a self-adhesive seal will not cause difficulties even for a person who does not have special training.

Bristle or adhesive-based metal wire will help to deal with gaps in sliding or swing gates. It is best to protect wooden canvases in such a way that they are in a metal frame - the selected material for insulation will be attached to it.

If these are interior structures, then a strip linear brush on the adhesive layer can protect against dust penetration into the room and heat leakage. To achieve good insulation, flashings are used from multi-row and frequent pile. The surface on which the seal is to be installed must first be cleaned of debris and degreased with a solvent or alcohol.
