In accordance with Decree of the President of the Russian Federation of May 12, 2008 N 724 "Issues of the system and structure of federal executive bodies" The Government of the Russian Federation decides:
2. Allow the Ministry of Energy of the Russian Federation to have 8 Deputy Ministers, including one First Deputy Minister and one Secretary of State - Deputy Minister, as well as up to 15 departments in the structure of the central office in the main areas of activity.
5. The Ministry of Energy of the Russian Federation is a federal executive body responsible for the development of state policy and legal regulation in the field of energy saving and energy efficiency improvement on information support for energy saving and energy efficiency measures, accounting for energy resources used.
The Ministry of Energy of the Russian Federation is a federal executive body that implements state policy and legal regulation in the field of heat supply in terms of heat production in the mode of combined generation of electric and thermal energy, as well as the transfer of heat energy produced in the mode of combined generation of electric and heat energy, including that produced by sources of thermal energy, if such sources of thermal energy are included in the heat supply scheme, which includes sources of combined generation of electrical and thermal energy.
The Ministry of Energy of the Russian Federation, within its competence, performs the functions of creating, operating and improving the state information system of the fuel and energy complex.
2. The Ministry of Energy of the Russian Federation is guided in its activities constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, international treaties of the Russian Federation, as well as these Regulations.
3. The Ministry of Energy of the Russian Federation carries out its activities directly and through its subordinate organizations in cooperation with other federal executive authorities, executive authorities of the constituent entities of the Russian Federation, local governments, public associations and other organizations.
II. Powers
4. The Ministry of Energy of the Russian Federation exercises the following powers:
4.1. submits to the Government of the Russian Federation draft federal laws, regulatory legal acts of the President of the Russian Federation and the Government of the Russian Federation and other documents requiring a decision of the Government of the Russian Federation on issues related to the established scope of the Ministry, as well as a draft plan work and predictive performance of the Ministry;
4.2. based on and pursuant to Constitution of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation independently adopt the following regulatory legal acts:
4.2.1. form of presentation of investment programs of subjects of natural monopolies in the fuel and energy complex;
4.2.3.1. standard terms of long-term contracts for the supply of coal (oil shale) and (or) products of its processing;
4.2.6. the procedure for the formation and placement of a technological power reserve in the Unified Energy System of Russia;
4.2.7. the procedure and conditions for maintaining technological reserves of capacities for the production of electrical energy;
4.2.12. the procedure for determining the insurance risks of the subjects of operational dispatch control in the electric power industry;
4.2.13. mandatory for buyers of electricity in the wholesale market the volume of purchase of electricity produced at qualified generating facilities operating on the basis of the use of renewable energy sources;

4.4.4. forecasting a possible shortage of electric power in certain price zones of the wholesale electricity and power market and creating favorable conditions for capital investments or, if necessary, for state investments in the construction of electric power facilities in order to prevent the occurrence of a shortage of electric power;
4.4.6. activities related to the preparation and implementation of production sharing agreements;
4.4.9. development and implementation of state policy in the field of gas supply;

4.5.5. standards for technological losses of hydrocarbon raw materials during mining, transportation of raw materials and products of its processing by pipeline transport;

5.2. establish in the manner prescribed by the regulatory legal acts of the Russian Federation, departmental insignia, giving the right to confer the title of "Veteran of Labour" and other departmental awards and award them to employees of the Ministry, subordinate organizations, as well as other persons operating in the established field, approve the regulations on these badges and awards, as well as their descriptions;
5.3. involve in the prescribed manner for the study of issues related to the field of activity of the Ministry, scientific and other organizations, scientists and specialists;
5.4. create coordinating and advisory bodies (councils, commissions, groups, colleges), including interdepartmental ones, in the established field of activity;
5.5. establish in the prescribed manner print media for the publication of normative legal acts in the established field of activity, official announcements, placement of other materials on issues within the competence of the Ministry.
6. When exercising legal regulation in the established field of activity, the Ministry of Energy of the Russian Federation shall not have the right to establish the functions and powers of federal state authorities, state authorities of the constituent entities of the Russian Federation, bodies local self-government, and is also not entitled to establish restrictions on the exercise of the rights and freedoms of citizens, the rights of non-state commercial and non-profit organizations, except in cases where the possibility of introducing such restrictions is expressly provided for by acts of authorized federal executive bodies constitution of the Russian Federation, federal constitutional laws, federal laws and acts of the President of the Russian Federation and the Government of the Russian Federation issued on the basis and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws.
III. Organization of activities
7. The Ministry of Energy of the Russian Federation is headed by the Minister, who is appointed and dismissed by the President of the Russian Federation on the proposal of the Chairman of the Government of the Russian Federation.
The Minister is personally responsible for the fulfillment of the powers assigned to the Ministry of Energy of the Russian Federation and the implementation of state policy in the established field of activity.
The Minister has deputies who are appointed and dismissed by the Government of the Russian Federation.
The number of Deputy Ministers is established by the Government of the Russian Federation.
8. Structural subdivisions of the Ministry of Energy of the Russian Federation are departments in the main areas of activity of the Ministry. Departments are made up of divisions.
9. Minister:
9.2. approves regulations on structural subdivisions of the Ministry;
9.3. appoints and dismisses employees of the Ministry in accordance with the established procedure;
9.4. decides according to legislation of the Russian Federation on the state civil service issues related to the passage of the federal state civil service in the Ministry;
9.5. approves the structure and staffing of the Ministry within the limits of the payroll fund and the number of employees established by the Government of the Russian Federation, the cost estimate for its maintenance within the limits of the appropriations approved for the relevant period and provided for in the federal budget;
9.6. submits to the Government of the Russian Federation drafts of normative legal acts, other documents specified in subparagraph 4.1 of this Regulation;
9.7. submits to the Government of the Russian Federation in accordance with the established procedure proposals for the creation, reorganization and liquidation of organizations subordinate to the Ministry;
9.9. submits, in accordance with the established procedure, employees of the Ministry and other persons carrying out activities in the established field, for conferring honorary titles and awarding state awards of the Russian Federation, a Certificate of Honor of the President of the Russian Federation, for encouragement in the form of declaring gratitude to them from the President of the Russian Federation;
9.10. issues orders of a normative nature, and on operational and other current issues of organizing the activities of the Ministry - orders of a non-normative nature.
10. Financing of expenses for the maintenance of the Ministry of Energy of the Russian Federation is carried out at the expense of funds provided for in the federal budget.
11. The Ministry of Energy of the Russian Federation is a legal entity, has a seal depicting the State Emblem of the Russian Federation and with its name, other seals, stamps and forms of the established form, accounts opened in accordance with legislation Russian Federation.
The Ministry of Energy of the Russian Federation has the right to have a heraldic sign - an emblem, a flag and a pennant, established by the Ministry in agreement with the Heraldic Council under the President of the Russian Federation.

1. The Ministry of Fuel and Energy of the Russian Federation (Mintopenergo of Russia) is the central body of the federal executive power that manages the functioning and development of the fuel and energy complex of the Russian Federation, as well as coordinating the activities of independent enterprises and organizations in the electric power industry, oil production, oil refining, gas, coal, shale and peat industry, gasification and gas supply of gas facilities, oil product supply system and main oil, gas and oil product pipelines, specialized engineering, construction, scientific, design and other enterprises and organizations (hereinafter referred to as enterprises of the fuel and energy complex) on issues related to its keeping.
2. The Ministry of Fuel and Energy of Russia in its activities is guided by the Constitution of the Russian Federation, the Law of the Russian Federation "On the Council of Ministers - the Government of the Russian Federation" and other legislative acts of the Russian Federation, decrees and orders of the President of the Russian Federation, decisions and orders of the Council of Ministers - the Government of the Russian Federation, as well as by this Regulation.
3. The Ministry of Fuel and Energy of Russia carries out its activities in cooperation with other central bodies of federal executive power.
4. The Ministry of Fuel and Energy of Russia carries out its work on the principles of close interaction with the executive authorities of the republics within the Russian Federation, territories, regions, autonomous entities, the cities of Moscow and St. Petersburg in order to harmonize and take into account the interests of the fuel and energy industries and regions, assists these bodies in the restructuring of the fuel and energy complex, the creation of new jobs, the development of industrial and social infrastructure.
5. The main tasks of the Ministry of Fuel and Energy of Russia are:
development and implementation in accordance with the current legislation of the state policy in the fuel and energy complex of the Russian Federation;
ensuring the needs of the national economy and the population in various types of energy, their rational and safe (in environmental and technological terms) use and savings in all areas of consumption;
ensuring the efficient and sustainable functioning of the fuel and energy complex;
organizing the development of the main directions for the development of the fuel and energy complex;
participation in the development and implementation of the state policy for the formation of market relations based on the development of a competitive environment, changes in property relations in the fuel and energy complex, the implementation of sectoral demonopolization programs;
expanding the participation of the fuel and energy complex in solving the macroeconomic problems of Russia, integrating its economy into the world economic space, increasing the efficiency of the export of fuel and energy resources, facilitating the attraction of foreign investment in the development of the complex, encouraging investment activities abroad of enterprises of the fuel and energy complex, using in the interests of national economy opportunities of international organizations of the fuel and energy profile;
implementation of state regulation of the activities of enterprises of the fuel and energy complex by organizing the development, approval in accordance with the current legislation of regulatory and technical acts, standards, norms and rules in the field of organizing the operation, repair and construction of enterprises of the complex and monitoring their compliance;
decision, in agreement with the state authorities and administration of the constituent entities of the Russian Federation, local governments, on the placement and construction of large enterprises of the fuel and energy complex.
6. The main functions of the Ministry of Fuel and Energy of Russia are:
development of proposals for the formation and participation in the organization of the implementation of sectoral demonopolization programs, state targeted scientific and technical programs to create new energy technologies and equipment, solve energy conservation problems, introduce highly efficient, environmentally friendly and reliable technological processes, including those based on the conversion of defense and machine-building complexes;
development and implementation of state policy in the field of design and construction of enterprises of the fuel and energy complex;
ensuring state energy supervision, state control and supervision over the rational use of oil, gas and their products, over the quality of peat in all areas of the economy of the Russian Federation, as well as state supervision over the facilities of the fuel and energy complex in terms of ensuring the safety of navigation, underwater technical work , operation of hydraulic structures and prevention of water pollution by oil;
ensuring measures to comply with the requirements for the protection of subsoil and other natural resources in the implementation by enterprises of a complex of economic activities;
coordination in accordance with the current regulation on licensing the procedure, terms and conditions for involvement in the development of existing and newly discovered oil, gas and coal fields;
participation in the establishment of the main technical and economic indicators of oil, gas and coal production for the submission of licenses and in monitoring the implementation of the stipulated conditions for the development of deposits under existing licenses, as well as the examination of calculations substantiating the amount of recoverable reserves of oil, gas and coal;
ensuring organizational, technical and economic conditions for improving the environmental and technological safety of existing enterprises and compliance with environmental and operational standards of newly commissioned and reconstructed enterprises;
development of proposals for demonopolization, socio-economic development, effective implementation of pricing, investment, tax, concession policies, the introduction of scientific and technological progress that ensure the reliability, stability, efficiency and safety of the fuel and energy complex; credit and financial regulation of the functioning and development of the complex;
development of proposals on legislative and regulatory acts regulating the activities of the fuel and energy complex, participation, together with interested organizations, in the coordination, implementation and control of the implementation of legislative and regulatory acts on issues of the fuel and energy complex;
participation in the improvement of the economic mechanism for regulating the work of enterprises of the fuel and energy complex in the context of the transition to market relations; preparation, together with interested organizations, of proposals for the creation and regulation of economic and legal foundations for the development of market relations, direct commercial ties aimed at sustainable provision of the national economy and the population of the Russian Federation with fuel and energy, as well as reliable material and technical supply of enterprises of the complex;
development of proposals for the formation of tariffs, prices, subsidies for fuel and energy resources and other products of the sectors of the complex;
organizing and coordinating the fulfillment of obligations under interstate agreements of the Russian Federation relating to the issues of the complex's activities;
assistance in attracting foreign investors in accordance with the established procedure for the development of the sectors of the complex and increasing their export potential; assistance to the enterprises of the complex in the implementation of foreign projects;
participation in the development and implementation, together with the Ministry of Foreign Affairs of the Russian Federation, the Ministry of Foreign Economic Relations of the Russian Federation and other central federal executive authorities, of the state policy in the field of export-import operations;
creation, in accordance with the established procedure, of off-budget sectoral funds to finance capital construction, research and development, insurance and others;
creation, in accordance with the current legislation, of a currency fund for the purchase of equipment and materials for general industry purposes;
preparation and organization of the execution of proposals for the establishment of quotas for export-import operations according to the range of products of the fuel and energy complex, participation in the formation and distribution of quotas for the transfer of oil, gas, coal and products of their processing and electricity from Russia, bringing quotas to manufacturers of these products in accordance with the established order;
interaction with enterprises of the fuel and energy complex in order to create conditions for the safe operation of production, working conditions in the sectors of the complex, the introduction of new means and methods for preventing occupational diseases, industrial injuries and accidents, the development and approval, in agreement with the relevant authorities (including trade unions), industry rules and standards and control over their observance;
organization, coordination and control, together with the State Committee of the Russian Federation for Civil Defense, Emergency Situations and Elimination of the Consequences of Natural Disasters, the implementation of measures aimed at preventing and eliminating the consequences of emergencies in the system of the fuel and energy complex of Russia, the introduction of mobilization training, the implementation of civil defense measures ; ensuring reliable protection of state secrets, other classified information and special communications, the implementation of methodological guidance in these areas of work on the basis of unified nationwide legislative and regulatory acts;
providing methodological guidance for the activities of geological and surveying services of mining enterprises;
implementation through the industry control system of measures to ensure the safety of work and protection of subsoil, the execution of relevant legislative acts at the enterprises of the complex;
creation, provision of technical guidance and control over the activities of mountain rescue units and detachments, as well as paramilitary security units included in the system of the fuel and energy complex, and approval in the prescribed manner of their locations;
coordinating the work of departmental and professional emergency rescue units that are part of the Russian system of warning and action in emergency situations, during emergency rescue and other urgent work;
management of the creation, ensuring readiness and functioning of the departmental subsystem of the Russian system for warning and action in emergency situations in accordance with the functions assigned by the Council of Ministers - the Government of the Russian Federation to the Ministry of Fuel and Energy;
participation in the implementation of a unified state policy in the field of personnel formation, employment, social protection of workers, pensions, development of labor relations on the basis of social partnership, prevention and resolution of labor conflicts, youth and migration policy;
organization of training, retraining and advanced training of personnel for enterprises of the fuel and energy complex; implementation, within the limits of the competence and authority established by law, of the management of the sectoral system of educational institutions;
providing methodological assistance to enterprises of the fuel and energy complex in the implementation of state social insurance and compulsory insurance against industrial accidents and occupational diseases, organizing a complex of medical and preventive care at enterprises, participating in the preparation of proposals for improving preferential pension provision;
assistance in the development and regulation of inter-republican, regional economic relations of enterprises of the complex with consumers of the products of the complex and suppliers of material and technical resources on the basis of business partnership and economic interest;
implementation of the functions of the general supplier in relation to assigned facilities being built abroad with the technical assistance of the Russian Federation;
analysis of the production and economic activities of enterprises of the fuel and energy complex with the provision of constant information flows for the implementation of state regulation in the prescribed manner;
development of proposals to stimulate the increase in productivity and labor efficiency, a social protection mechanism and recommendations for organizing remuneration for employees of enterprises of the fuel and energy complex, participation in the development, conclusion and implementation of sectoral (tariff) agreements in accordance with applicable law;
organization of fire prevention works aimed at ensuring reliable and trouble-free operation of enterprises of the fuel and energy complex;
7. The Ministry of Fuel and Energy of Russia to perform the tasks and functions assigned to it:
forms a unified strategy for scientific, technical, industrial, technical and socio-economic development of the fuel and energy complex;
develops, with the involvement of other ministries, departments and industry enterprises (joint stock companies), a strategy for the development and use of hydrocarbon resources, the fuel and energy balance of the Russian Federation by type of fuel and specific consumers, organizes and coordinates the activities of industry enterprises (joint stock companies) aimed at ensuring reliable and sustainable supply of the national economy and the population with fuel, thermal and electric energy, concludes, on behalf of the Council of Ministers-Government of the Russian Federation, production contracts with enterprises of the complex;
develops, together with other interested federal executive bodies, the main directions of the state policy in the field of energy conservation, coordinates the most important work to improve the efficiency of energy use in the national economy and takes part in the preparation of proposals for their financing (the paragraph is additionally included by the Decree of the Government of the Russian Federation of November 2, 1995 No. 1087);
submits proposals to the Council of Ministers - the Government of the Russian Federation with the involvement of other ministries and departments for the implementation of state programs in the field of fuel and energy supply: on financial, credit and economic issues, including a draft budget request for financing the activities of the fuel and energy complex, on development of incentive measures to increase labor productivity and efficiency, according to the mechanism of social protection, to organize the remuneration of employees of enterprises of the fuel and energy complex, to regulate labor relations in the sectors of the complex and other issues of the fuel and energy complex in accordance with applicable law;
creates an information databank of the fuel and energy complex of the Russian Federation on the basis of information received from the enterprises of the complex, and submits information to the federal economic bodies on the basis of established statistical reporting;
creates and develops means and systems of production, technical and information communication of branches of the fuel and energy complex;
acts on behalf of the Council of Ministers-Government of the Russian Federation as a customer when placing orders for the supply of products, performance of works (services) for state needs at the enterprises of the complex and providing these enterprises with the necessary resources in the prescribed manner together with the Ministry of Economy of the Russian Federation, the Ministry of Finance of the Russian Federation and other interested organizations;
concludes contracts with heads of federally owned state enterprises and approves the charters of such enterprises when delegating these functions to the Ministry of Fuel and Energy of Russia by the State Committee of the Russian Federation for State Property Management;
gives, on behalf of the State Committee of the Russian Federation for State Property Management, conclusions on draft decisions on the creation, reorganization and liquidation of federally owned fuel and energy complex facilities, and also develops proposals for recommendations on taking into account the characteristics of industry enterprises taken into account during privatization and the exercise of powers owner;
participates in the examination of projects and estimates for the construction of large, intersectoral enterprises of the fuel and energy complex, as well as the most significant scientific and technical developments for the implementation of the tasks facing the complex;
submits candidates to the State Committee of the Russian Federation for State Property Management, the Russian Federal Property Fund, committees for property management and the property fund of national-state, national-territorial and administrative-territorial entities to involve them in the prescribed manner in exercising the powers of the state as the owner of enterprises ( shares in the authorized capital) as representatives of the said bodies;
determines, together with branch enterprises (joint-stock companies), the procedure for managing energy product pipeline systems and the federal energy system;
receives from the State Committee of the Russian Federation on Statistics and enterprises of the fuel and energy complex statistical data on issues within the competence of the Ministry of Fuel and Energy of Russia;
assigns industry honorary titles to the best employees, and also awards, in accordance with the established procedure, advanced workers of the complex's industries with appropriate badges and certificates of honor;
convenes conferences and meetings in accordance with the established procedure, organizes exhibitions on the problems of improving and developing the activities of the branches of the complex.
8. The Ministry of Fuel and Energy of Russia is headed by a Minister appointed by the President of the Russian Federation.
The minister has deputies appointed by the Council of Ministers of the Government of the Russian Federation. The division of duties among the Deputy Ministers is made by the Minister.
9. Minister of Fuel and Energy of the Russian Federation:
directs the activities of the Ministry on the basis of unity of command;
bears personal responsibility for the fulfillment of the tasks and functions assigned to the Ministry, establishes the degree of responsibility of the Deputy Ministers and members of the collegium, heads of structural divisions of the Ministry;
issues orders, instructions and instructions within its competence, which are obligatory for execution by the divisions of the central office, as well as enterprises of the fuel and energy complex;
approves, within the established number and wage fund of employees, the structure and staffing of the central office of the Ministry, the regulations on its structural divisions, as well as the cost estimate for the maintenance of the central office within the limits approved for the corresponding period of appropriations.
10. In the Ministry of Fuel and Energy of Russia, a collegium is formed consisting of the Minister (chairman of the collegium), his deputies, heads of leading departments of the Ministry and enterprises, approved by the Council of Ministers - the Government of the Russian Federation.
The Ministry of Fuel and Energy of Russia, at regular meetings of the collegium, considers the issues of the activity and functioning of the fuel and energy complex. The decision of the collegium is carried out by orders of the Ministry.
11. In the Ministry of Fuel and Energy of Russia, a scientific, technical and economic council is being formed with sections on individual problems. The composition of the scientific, technical and economic council and its regulations are approved by the Minister of Fuel and Energy of the Russian Federation. Organizational and technical support for the work of the council is carried out by the central office of the Ministry.
12. The Ministry of Fuel and Energy of the Russian Federation is a legal entity, has a seal with the image of the State Emblem of the Russian Federation and with its name, settlement and other accounts in banking institutions.
13. Expenses for the maintenance of the central office of the Ministry of Fuel and Energy of Russia are financed from the funds of the republican budget of the Russian Federation allocated for the maintenance of the central bodies of the federal executive power of the Russian Federation.
14. The Ministry of Fuel and Energy of Russia is located at the address: Moscow, Kitaisky proezd, house 7.
